Bloodrun
It is now required that the Members of YCM, ask permission from the artist, before using any images from DeviantART. Hi' date=' I just came here from deviantART and am very shocked to find the site listed as a resource site for images. The majority of images on deviantART are copyrighted to the artists who upload them, and it is not a free image site. Neither is google or photobucket. I, and the artists at deviantART, would very much appreciate deviantART being taken off the list of sites to get images from, and perhaps a stricter rule of requiring members to list where they got their images would help prevent copyright infringement. Thank you :)[/quote'] You quite clearly do not understand international copyright laws. Unless you are using the images for something that falls under the fair use policy (USA only) (eg education' date=' the press), which you are not, it is [b']illegal[/b] to re-post images copyrighted to someone else without their explicit permission, which to be legally binding should be in some written form. Crediting them is not enough, although it is a step towards making the artist hate you less when they find out. All images and all other media forms are copyrighted the instant they come into existance in a tangible form (ie visible on the computer screen rather than just in the artist's head still) Images and videos are protected by the same copyright laws. Do you think Warner Bros wouldn't sue someone for displaying their films just because they credited Warner Bros where they posted the film? No, they would prosecutre the person and have the video removed. Same goes for images. If you display them without permission the artist has the right to sue you for compensation and to have the image forcably removed. Just because you find the image online does not mean it is in the public domain. Unless the image has some text under it saying "no rights reverved, do what you like with it" or is released under a creative commons licence (and be careful to read what the licence allowes) then you cannot re-distribute or alter the image without permission. Now to the issue of you listing deviantart as a resource. About 90% of images on deviantart, the artist reserves all rights, ie they are the only person with the right to display, print, sell, etc, the image. There *is* a resources gallery on deviantart where people provide stock images or other various resources. HOWEVER! These again have most rights kept by the creator, and most dA stockers say their images can only be used for art that will be uploaded only to deviantart and you have to get permission for prints, non-deviantart use, etc. They also usually require the images to be manipulated beyond just crop/re-coloring and to be told when it has been used. So I would really reccommend you remove deviantart from your resource list. Google also as that is a search engine and images it finds are usually not in the public domain, it depends on the site they came from. Might I reccommend you put www.sxc.hu on the list? Again, you must follow the stockers terms and conditions on the images, but people who post there tend to have very relaxed licences, for example the royalty free licence allows: * In digital format on websites, multimedia presentations, broadcast film and video, cell phones. * In printed promotional materials, magazines, newspapers, books, brochures, flyers, CD/DVD covers, etc. * Along with your corporate identity on business cards, letterhead, etc. * To decorate your home, your office or any public place. The licence the stockers on sxc.hu have chosen can be found on the column to the right of the images. Members, MUST, ask permission first. Any threads that do not show permission from the artist (from DeviantART) will be deleted. This must be done, and will not be tolerated, or avoided. You go to the page where the image is, you leave a comment where the image is asking if you can use it. When the artist replies saying yes, provide the link in your thread. About the distinquishing part, from whether it from Google or DA, well, a link must be given to where you get the picture from. As for repercussions, the thread will be deleted, if permission is not given. If it happens more then once, that member will get a warning. If it continues, a one day ban will be issued, if it continues, then, yeah..
Kingdom Xathers
Personally, I think it's about time a rule like this is being enforced. I kinda felt guilty using someone else's images without permission. (Coincidentally, I got a note today on dA from someone whose image I used, asking me to ask permission next time.) OMGAKITTY
Heh...I brought this issue up when I first joined. Everyone told me not to worry about it :/ The internet does make copyrights harder to enforce.. Anyways, on practical terms, how are you going to enforce this? What I mean is, how are you going to get proof that they received permission? Monkey
so how do we contact the artists? Or like for the cards we havE? How do we go fund that image, and then contact the artist and show an approval?
Guest Welche
Now I will never be able to post a card again. YCM, I will be gone soon.
Monkey
so in other terms, people who don't have the artists aproval (which is everybody almost) cantbpost their cards unless they will be prosecuted?
DesCrow
http://www.copyright.gov/fls/fl102.html I know it's a forum rule now, but Fair Use is a law.(which I guess doesn't apply to overseas DA'ers) Whatever the case, things should be slowing down here quite a bit. oO C H A O S Oo
If you haven't on other existing threads, do you still need to get a post-permission or something? Or is it just relating to threads from here on out.

OMGAKITTY
The issue is the legitimacy of the permission...Screenshots are out, too easily edited.Quotes are out because....that's....no.You'd pretty much need a direct link, but that brings it back to the issue of PM's and pic comments...-____________________-Guess I'll be switching to photobucket? Jericho
Now I think this is a bit ridiculous. Well, only ridiculous if the image shows no form of actual copyright. If the image is on the internet, but it is not copyrighted, it has officially been released into the public domain, therefor anyone can use the afore mentioned uncopyrighted image without the consent of the artist legally. But its not like legality has ever effected YCM. Sic Semper Evello Mortem Tyrannis.
BulletMan
I now can no longer post any cards anymore. It is the end for many YCM makers. I think this rule is unfair. We already credit them. So why do we need there permission? If they come on and see 1 of our cards and it has their pic they will go like, "Hey!" but if we credit them they will go "Yeahh. thats my pic. I will totaly post and say thats my pic". so this rule should not be applied.

Kingdom Xathers
Good lord, will you guys get a f(honk)ing hold of yourselves! All you have to do is ask permission, and if they say "no" then deal with it. Otherwise, learn how to use PhotoShop, get better at drawing, and use those skills to create your own images. I've done so with a few of my own drawings and they turned out alright. All I'm saying is, I don't see why everyone and their grandmother is having a rash-and-a-s*** over this whole deal. You post their movies on youtube or a site like that, they'll still get it removed. And the rule is in no way unfair. It's their art. They spend hours creating it. And you have to understand the amount of art theft that goes on with good artists on dA. Many of them are just completely fed up with the use of their art without permission for any purpose. True, this is a major inconvenience to everyone, and something that, for the most part, will be incredibly hard to enforce (I mean, things from dA still get redistributed all over the net...photobucket and google images are going to give you pics from dA also...). But I can see where it is coming from. Also, we are technically in violation of copyright :/Until this gets settled, I'm pretty much putting a stop to my card making.
