Deviantart Copyright infringement

Recommended Posts

Hi I am a member of deviantart concerned with members of this site being told that they may take art pieces from the site with out first getting permission from the members whoms art they use. As deviantart is a United States based organization, taking art with out permission is illegal and can be acted upon through legal terms. Just because deviantart is on the internet does not mean that it is legal to take the art with out permission or payment. Stealing mp3 files is illegal and can be acted upon, the same goes for art files and legal action can be taken by deviantart members or even deviantart. So for those of you who want to find legal files for your cards and not get into legal trouble (that could in fact break this site), I suggest we find some alternatives here and fast!

We aren't taking credit, we are simply using them to make cards, our hobbies. We aren't selling them, or taking full credit of the picture, so it is not stealing, as it is entertainment and we are not taking credit for your drawings, just taking credit for the card idea. Why do you think we post links to where you made it? It just makes you actually more well known and more famous.

It does not seem to work that way. You must let the public know or it will do neither side good. Please respect that I am one member who is doing your public a favor, some of the more well known artists will not be so forgiving, they will sue. It is very important for it to both be enforced (for the sites sake) and publicly made known (for your members sake).

I can see this, but view it from my side, please.

The government is tapping peoples phone calls, and have for a while, but in the beginning they didnt tell anyone. They did this to ensure that people wouldn't get into chaos. The minute they said something they uproared, now I admit that the uproar was mainly because they held it a secret, but take it like this:

If I told you the fridge was rigged to blow if you opened it, you wouldnt open it would you?

I'm wondering....

Why do any of you really care? It's not like any of the card makers here are obtaining any profit from your artwork' date=' they're just making fake children's trading cards. What's the big deal?

[/quote']

Justification of rightful authority.

Apparently bossing around kids makes the DA members feel good about themselves. =)

Big profile members (and even small profile members) will not see posting links as sufficient they will most likely not even want their art used, especially without their permission. It is a touchy business and they hold the reins. Believe me you don't want to be on the bad side of a high profile artist with copy right infringement (no matter who you are!). It is messy business, I really urge you to work it out with the artist or not use it.

And have any of the dA members here actually threatened us with legal action.

I can count the number of dA users who have come here to complain about this on one hand. You all make it out to seem like we're plastering our names all over your works. Reality check; we aren't. For the most part, we're simply using them to help illustrate concepts, nothing more, nothing less. If your gonna get so anal-retentive over this, then why don't you go complain to the 10000+ members of this site who only use the card maker, and not the forum? By your logic, they are breaking the rules as much as we are. We are not claiming the art as our own, we will not redistribute the art to other external sites. Can't you figure that out?

Wait... Are you inferring you don't download music, or any copyrighted materials without charge?

You're on the internet, clearly you're lying.

Also, this site's been through this before, nothing happened because copyright law on the internet is like the law banning adultery in Massachusetts, it doesn't affect the way anything is worked and no one ever thinks about it. Stop whining, I'll give it to you that people probably should credit the artist that they steal the artwork from, but its art, and its on the internet, so it isn't a big deal and it isn't worth taking seriously. You deviantfags posted it for the public to view, this is exactly what you should expect.

Find something better to do.

In this case the fridge is filling with more and more explosives everyday and if you don't open it soon the damage will get worse and someone you don't want to have open it (Large profile DA artist or DA company) will and then you will have some real trouble. I say open the fridge now and start cleaning up and rehabilitating the situation. If you want some help doing that there are some of us who would be more than willing to help you. We aren't here to hurt you, we are here to help make some repairs.

Bloodrun, thank you very much for being respectful throughout this discussion.

1) Users of DA post thier works in a public domain. Unless issued creative commons licenses or copyrights from the government, their art is in the public domain in the same way Beethoven's 5th Symphony is.

2) You only complain here, but not on any other site that has the art of DA users like PhotoBucket.

3) No profit=no legal action, especially without copyright or creative commons licenses.

4) I highly doubt that any judge or jury would convict people for "using images for a fake version of a children's card game".

So please, SHUT IT.

well, some of the members of DA aren't really active unless they really, really like making art. and plus, when the Permission idea was released, members fussed about it,and started leaving take [Dark] for example,he was a really really good card maker, and when the Idea came,he got down, and quit, now he's back, and making cards again! :D
