Federal Copyright Law, Limits and Rights Infringment

With Copyright based lawsuits on the rise, I have decided that now is a good time to discuss the limits of Federal Copyright law.

Recently lawsuits have been filed for...

 

-The infringment of Copyright law by the creator of the Obama "Hope" picture.

-The infringment of Audiobook Copyright laws by the creators of Text-to-Speech software.

 

These are the two main cases to be analyzed although more examples are welcome.

 

So, when does the use of an image or technology become a violation of personal rights, and when are items changed enough so as to be considered an original piece of art?

With the internet now, copyright is extremely hard to keep....As you can see from the issues this site has had with dA. And sites like youtube (well, they actually do seem to try to keep copyrighted stuff out, but other video streaming websites) host dozens of copyrighted videos.

 

And I think dA has changed it's policy so tracing artwork isn't copyright violation anymore :/

 

Anyway that doesn't really relate directly to the question you posed.

You already know my opinion on the "Hope" one.

 

Hm...that's really hard to define when something becomes sufficiently "different" from something else to be considered original.

I really don't know.

I guess in the end, I'd say always ask permission first, that way you can never be wrong.

Is it copyright infringement to use a sound sample from another song as a ground track in a self-made song?

 

Depends what context the song is made in, if the song is made for the purposes of school music work or has education value then it is portected under Fair Use Rights, It also depends on the size of track that is taken and wether the music is used to make money. Also if a piece of music is taken to be shown and analysed then that is also covered.

 

This is why YCM is covered from dA by Fair Use Rights.

1) The pictures we take and reduced in size and are not the main focus of the card.

2) The cards produced are not being used to produce an income.

3 (and most importantly)) The cards produced and posted are posted to be commented and critcised on, this includes the art on the card.

4) None of us actually claim to have made the art in the first place and most members know that credit is needed.

 

Some aspects of copyright are over the top however some is needed to keep people from scrouging off other people's creativity
