Bullied Special-Ed Student gets charged for recording his Bullies

For short. This guy was being heavily bullied and even physical violence like hitting his head with books or trying to burn him with a lighter, some of these actions even during class-time. Though the teachers din't do anything, the principal didn't do anything, the police, the judge, or the jury, neither seemed to care, ignoring his blatant and irrefutable evidence and instead finding him guilty of "wiretapping". 

 

During my high school days, I did have the chance to experience people targeting me and even someone once almost burned my hair with a lighter and spray deodorant, so this is particularly enraging for me to find. I'm just trying to contribute a little bit by letting others know of this.

What the hell did I just read?

That teacher, principal, officers and especially the judge who all said that this kid did the wrong thing should be immediately FIRED (I'll omit the extra stuff). They think violence is OK? What are they, sadistic or something? 

 

All the kid was trying to do was show (without doubt) that bullies were picking on him, since apparently the staff at that school were ignorant to deal with it. And this happens?

 

I'm glad this doesn't happen down here, but needless to say that I am pretty peeved after reading this.  The recording charges are stupid also (it's somewhat of a public place); again the kid did it because he had no other options to prove it (and again, the principal didn't do BS about it)

 

My sympathy goes out for the kid/his mom for having to face this injustice. Hopefully they get this conviction overturned and the bullies get disciplined. As for the authorities (judge/police/principal and possibly the teacher), they should get themselves fired and never be allowed to practice their professions ever again.

 

(Showed this to my parents right after; even they agree that this is just stupid)

 

 

I held back on the profanity since YCM is a child-friendly site, but that pretty sums how I feel about this.

I'm starting to think school shootings are a good idea. 

 

Of course I'm kidding, but the teachers, principle, bullies, police, and judge can rot in hell for all eternity. 
I'm freaking sick of the police. Go to hell, all of you. (the police).

 

I'm so pissed. I'm being as rational as I can. 

 

This video is making me realize how even more pissed off I am. I'm glad people like him speak up.

 

Our justice system is a piece of freaking crap. 

This is why I say justice is one of the world's greatest lies.

2 things:

1. technically, he shouldn't be able to be charged for wiretapping because he was in the room at the time of the recording. If he wasn't recording himself as well, then they could charge him, but he shouldn't be able to be charged for this.

2. This isn't as bad as the kind of victim blaming I've seen with high school rape victims who towns turned against because the person who raped them was a well known person around town (or a high-school athlete), but this is pretty fucking awful.

On your (2), I'd just say they are both very serious issues. Not to demerit the need of either of these to be addressed ASAP.

So yeah, both are fucking awful.

 

I know that when the word "bullying" comes afloat some people might picture the way they are portrayed on TV with a straw and paper balls in hand and just clean punches 1 on 1, while the victim brushes it off as routine, but IRL is much different.

In a lot of cases like this people jump to conclusions without knowing the full picture.

 

This is not one of those times.

 

The kid is getting f***ed sideways by the system.  Nothing else to it. 

So true, so true. I'm surprised this kid was so dang smart considering his condition-  this scheme was freaking brilliant and I wouldn't even think of it...not saying I'm a genius but this kid was really smart. And then he got hit hard. I can't stand this place...

 

Also TIL someone uses the f bomb more than Night *shot*

But it's understandable, given that this is a serious lack of justice in this situation. But that's how our justice system works.

 

To bring this into perspective on a related note, let's say some person attacks me in broad daylight for no reason at all. I defend myself using martial arts and disable their limbs, but not to the extent they end up severely injured or dead (just enough to buy getaway time). Said person takes it to court and even though there is sufficient evidence to prove that I was the victim in this case, court rules in the other guy's favor solely because I'm trained to do something of this caliber and he probably didn't. 

 

So they back up some random mugger instead of siding with a person trying to protect their own life? That's just twisted logic at best.

 

 

Going back on topic and basing off of what the bullies allegedly did to this kid, they should be charged with assault and sexual harassment (referring to the comment about telling kid to pull pants down). As for the wiretapping charge, the kid was only recording what the bullies were doing to him; not trying to leak private info from the government.

 

 

It's people like this (referring to the principal/law enforcement and the judge in this case) that make me have doubts about our justice system.

AlphaOmegaSin talks like that in pretty much all his videos actually. Though yes it's justified on this one.

 

[spoiler=Off-topic-ish: other stuff I've read/heard about]

There was a case in my country not that long ago where 2 thieves went inside a house with guns. Only a young man in his early 20s and his father lived there, and only the father was home. This young man was a black belt so he knew how to defend himself. When the man came back, he managed to react in time to disable the thieves, and in the struggling he accidentally killed one of them. End result? He was charged and given jail time as one of the most shitty uses of logic I had seen.

I told myself "At least on the US they are not so incompetent and twisted". Guess this article proves me wrong.

 

On another case I read about, a store owner got assaulted in his business one time. He decided to bring a gun with him because the police would just not do anything. The same thief went back and tried to do it again. He injuried the thief with the gun, I think on a leg. End result: The thief pressed charges against the store owner and won, making him pay for the hospital expenses and giving the store owner some time in jail.

 

I don't know enough curse words for this.

Schools are pretty much getting hasty and stupid once it comes to punishing people for stupid rules when they didn't know or have a meaningful reason for.

 

In Colorado, a little girl's friend developed cancer and had lost her hair, from either chemo or shave. To make her not feel so lonely and alienated, the little girl shaved her head for her friend, the school  dismissed her, saying she violated school dress code. They finally let her back in when the media attack them for the decision.

It's people not fixing things like this as soon as possible, which isolate people. How can victims become functioning members of society which schools are supposed to help make them, if the school fail them at every turn for their mental well being. The school is lucky the kid only recorded the bullies and didn't go extreme like other isolated children have. And to not even punish the bullies, how messed up is this school?

 

It makes me think of some of the lines in Death Note, about how rotten this world is, how the world is better off without some people and how justice is flawed.

I would say that the ruling is probably as questionable legally as it is immoral.

Recording is illegal in Pennysylvania unless in a public space, or with the consent of all recorded. Schools are a grey area, but, if you're willing to say something to a class of 20 or so people, the law would treat this as a public space.

Hence, prosecuting a boy of 'wiretapping' is ludicrous.

If what he did was illegal, than he should be charged.  It's as simple at that.  I'm not allowed to break the law because someone else is.  This isn't self defence.  The behaviour of the authority figures was deplorable but that doesn't change the fact that he may have broken the law.

You sicken me.

 

He had nowhere else to turn. The police ignored him, the school did nothing about it. His parents begged and begged, and they wouldn't do sh!t.

 

It may not be self-defense, but in a school where the bullied suffer day after day with no hope, the truth /needs/ to get out somehow. He clearly tried to do it otherwise, and only recorded as a last resort.
