Good for the many gays who have been waiting for this moment, as it is indeed something that cannot be trumped by Constitutional law. It's also been noted in an article somewhere that adoption under homosexual couples have little proof of any negative influence or development, so I think we can definitely say that we're starting to become a more progressive society as long as we can eventually shift the mentalities of many people to be in favor. It gave this ruling the backing that it needed due to the flexibility in the amendment's interpretation. A living amendment to shift with the times is good imo. Took them a while to get it legalized nation-wide (if by only a single vote), but certainly worth the wait. Certainly, opponents are going to keep on going about how this violates the Bible and other stuff; but it's your choice on whom you choose to be with for the rest of your life.That, and some churches and other "anti-gay" establishments are likely going to still deny services to gay couples because it violates their beliefs. That, or employers will terminate you for it. As some people in this thread already mentioned, we need to stop treating gay/transgender persons as inferior to those who choose to remain straight.The social stigma that exists regarding that in the US is rather disgusting; you can be fired for being a certain way or denied services to certain things. It's a person's own choice whether they choose to be straight, transgender, gay or whatever; while you might disagree with it due to your own beliefs, you still have to respect that choice. Opponents can argue all they want about it being in violation of religious doctrine and anything else, but they can't do anything to change a person's orientation. The hurdle for getting this legalized has been overcome, but there is indeed still any other challenges in the long-run (regarding how employers and others who are anti-gay continue to treat those who choose to be gay/trans). How the funk can mere mortals interpret the will of an omnipotent being? Moreover, why would said omnipotent being not just eradicate homosexuality if it offended him that much? People who talk about how gays are going to suffer the wrath of God make me tempted to show that it's not the wrath of some being who can't even bother to keep up with his checklist (one who has let the world degenerate to its current state no less) that we need to fear; the wrath of man is much faster and far more real, and I'd happily exhibit that by punching all those thoughtless sheep right in the mouth. If this offends your religion, your religion offends me. If your imaginary friend doesn't like it, that sucks and all, but if they haven't done anything about it yet, it obviously can't be that urgent. I'm going to cut myself off here before this post turns into a rant though. Long story short, it's legal now and America needs to get the funk over itself and grow up. But I feel like I should point out that sexual orientation is pretty much never a choice. My gay uncle explained to me that he would never have chosen to be gay in a world that systematically oppressed him growing up, that's just the way he was wired.Hopefully though, legalization will start paving the way for a future where LGBTQ kids growing up won't face that similar pressure. The thing I find most interesting and disconcerting about constitutions and judicial review is that there is no agreed upon method for interpretation. Methods, therefore, vary from textualism to original intent to living tree and different views can produce VERY different results. Because of this, judges on top courts get a lot of leeway in making decisions and are, at least to some extent, able to rule in pretty much any way on issue. Scalia (who is a textualist) declared that there was no way the constitution itself could be read literally to mean that gay marriage is constitutionally protected. I'm Canadian though and this case seems less cut and dry than our protection of sexual orientation rights. Our constitution says:"Every individual is equal before and under the law and has the right to the equal protection and equal benefit of the law without discrimination and, in particular, without discrimination based on race, national or ethnic origin, colour, religion, sex, age or mental or physical disability."Here the judges have now interpreted this list to be non-exclusive and have added sexual-orientation to the list. Why do I care about this? Because the courts are effectively writing the law now and adding to the constitution. Should an unelected body have the power to do this in a democracy? It's a discussion topic right? Let both pro and anti-gay people express what they want. It's not like this thread's sole purpose is to celebrate one side's victory over the other. In the end to me all that's changed is that the relationship between pro and anti-gay is reversed. Now gay people have an advantage in that the law supports them, instead of the other way round.
